U.S. Bioterrorism Act and Shipping Goods to the U.S.

Background Information

In response to the events of September 11, 2001, the U.S. Congress passed the "Public Health Security and Bioterrorism Preparedness and Response Act of 2002 (Bioterrorism Act)". This legislation is intended to protect the nation's food supply and addresses food and food ingredients for human or animal consumption in the U.S. A notice of affected shipments is required by the Food and Drug Administration (FDA) and must be provided electronically 2 to 8 hours prior to arrival, depending on mode of transport. As well, all food facilities must register with the FDA by the same date. In the event of a potential or actual bioterrorism incident or an outbreak of food-borne illness, the FDA needs facility information to help determine the location and source of the event and permit the agency to quickly respond and notify facilities that may be affected.

What does this mean for Researchers?

Shipments to the U.S. containing any of the above products must be handled using the following procedures.

Shipping Procedures

The university is registered with the FDA and the registration costs are being covered through the federal Indirect Costs of Research program. The College of Agriculture has agreed to be the central shipping point for goods affected by this legislation otherwise the university would be obliged to pay registration costs for each shipping point on campus. Therefore, all affected shipments MUST be handled through the College's shipping/receiving department. Our contracted customs broker - Thompson, Ahern & Co. Ltd. (TACO), acts as our designated U.S. agent as well as our Canadian agent.

The researcher is responsible for ensuring that a FDA Prior Notice Form is completed (see Key Links) and forwarded to Purchasing Services. TACO will handle faxing the actual application to the FDA for import approval. DO NOT package the goods for shipment until approval is received, in case there are delays. Once FDA approval is received, TACO will inform the researcher that the shipping process can proceed. Please forward a copy of the completed form to Shipping/Receiving/Stores in the College of Agriculture.

All information must be supplied on an Export Invoice (see Key Links)) and must contain a complete description of the goods being shipped, including the quantity. If the goods are perishable and being shipped on dry ice, the Dangerous Goods Act requires that "Dry Ice Shipment" be noted on all documentation.

Four (4) copies of both the FDA Prior Notice Form and the Export Invoice are required:

  1. One set must be included inside the parcel
  2. One set must be enclosed in an envelope labeled "Customs/FDA Information" and attached to the outside of the parcel
  3. One set must be provided to the driver of the transportation company providing the pickup/delivery service
  4. One set must be provided to Shipping/Receiving/Stores in the College of Agriculture for reference and filing with the FDA approval.
